The most common question we receive at Namaste Organics is also the most important one: is this legal? The short answer is yes \u2014 but understanding why requires a brief look at India's drug laws and the specific exemption that makes Vijaya extract products fully legal when manufactured under the right licence.

The NDPS Act and the Cannabis Exemption

The Narcotic Drugs and Psychotropic Substances (NDPS) Act of 1985 is the primary law governing controlled substances in India. Under this Act, cannabis is regulated — but not uniformly. The Act specifically prohibits two parts of the cannabis plant: cannabis resin (charas) and the flowering tops (ganja). However, Section 2(iii) of the NDPS Act explicitly excludes the leaves and seeds of the cannabis plant from the definition of prohibited cannabis. Vijaya extract is derived from cannabis leaves, not from the flowering tops or resin. This exemption is the legal foundation on which the entire Vijaya extract industry in India operates.

The Role of AYUSH Licensing

The Ministry of AYUSH (Ayurveda, Yoga, Unani, Siddha, and Homeopathy) regulates traditional Indian medicines. Cannabis (Vijaya) is listed as a permitted ingredient in Ayurvedic formulations under Schedule E(1) of the Drugs and Cosmetics Rules, 1945. Manufacturers who hold an AYUSH licence are authorised to produce Vijaya extract as an Ayurvedic Proprietary Medicine. This licence requires compliance with Good Manufacturing Practices (GMP), standardised formulation protocols, and state-level drug authority approval. Namaste Organics holds all required AYUSH licences and manufactures every product in a GMP-certified facility.

Is a Prescription Required?

Because Vijaya extract products are classified as Ayurvedic medicines, they are technically prescription-based in the same way as other scheduled Ayurvedic drugs. At Namaste Organics, we handle this seamlessly: when you place an order, one of our qualified doctors will call you to understand your needs, provide guidance, and generate a prescription before your order is dispatched. This process ensures every customer receives appropriate medical oversight and the right product for their condition.

Can I Travel with Vijaya Extract Products in India?

Yes — carrying AYUSH-licensed Vijaya extract products with your prescription is legal within India. We recommend keeping your prescription and the original packaging with you when travelling. While international travel with these products is not advisable given varying regulations in other countries, domestic travel within India is fully covered under the AYUSH licence framework. If you have any specific questions about your situation, our doctors and support team are available to advise.
